Please read these Terms of Service ("Terms") carefully before using the Studance online tutoring Studance (“Studance”, "Company," "we," "us," or "our") accessible at https://studance.link ("Website"). By accessing or using the Studance, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you should not use the Studance.

1. Definitions

"Studance" refers to the online tutoring website operated by Studance, accessible at https://studance.link.
"User," "you," or "your" refers to any person or entity accessing or using the Studance.
"Tutor" refers to an individual offering educational services on the Studance.
"Student" refers to an individual seeking educational services on the Studance.

2. Use of the Studance

2.1 Eligibility: You must be at least 18 years old to use the Studance. By using the Studance, you represent and warrant that you are at least 18 years old.

2.2 User Accounts: To access certain features of the Studance, you must create an account. You are responsible for maintaining the confidentiality of your account information, including your username and password. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.3 Prohibited Activities: You agree not to use the Studance for any unlawful purpose or any purpose prohibited by these Terms. Prohibited activities include, but are not limited to, engaging in harassment, impersonating others, distributing harmful or inappropriate content, or interfering with Studance's functionality.

3. Tutoring Services

3.1 Tutoring Listings: Tutors may create listings for their tutoring services on the Studance. Tutors are responsible for the accuracy and completeness of their listing information.

3.2 Student Bookings: Students may request tutoring sessions with Tutors through the Studance. Tutors may accept or decline such requests at their discretion.

3.3 Payment: Tutors and Students agree payment processing is provided by third-party payment processors including, but not limited to Stripe and TransferWise, allowing us to:

bill the Students in lieu of directly processing your credit/debit card information;
enable payouts to the Tutors.

For the avoidance of doubt, payment made by the Student to Studance shall satisfy the Student’s obligation with respect to the payment to the Tutor for the tutoring services provided via the Studance.

4. Code of Conduct

4.1 Respectful Behavior: All Users agree to engage in respectful and professional behavior while using the Studance. Harassment, discrimination, and inappropriate language or content will not be tolerated.

4.2 Intellectual Property: Tutors and Students agree to respect each other's intellectual property rights. Tutors retain ownership of their teaching materials, and Students retain ownership of their learning materials.

5. Liability and Disputes

5.1 Limitation of Liability: Studance shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of Studance or the services provided by Tutors.

5.2 Disputes: In the event of a dispute between a Tutor and a Student, Studance is not responsible for resolving such disputes. Users agree to handle disputes directly with each other.

6. Termination

6.1 Termination by Users: Users may terminate their accounts at any time by following the instructions on the Studance.

6.2 Termination by Studance: Studance reserves the right to terminate or suspend any User's account at its discretion, without notice, for violating these Terms.

7. Changes to Terms

Studance reserves the right to modify or revise these Terms at any time. Users will be notified of significant changes via email or through the Studance. Continued use of the Studance after such changes will constitute acceptance of the revised Terms.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Washington. Any legal actions arising out of these Terms shall be brought exclusively in the courts located in the State of Washington.

By using the Studance online tutoring Studance, you acknowledge that you have read, understood, and agreed to these Terms of Service. If you do not agree to these Terms, please refrain from using the Studance.
